Abstract

Examines the European Court of Justice ruling in Scarlet Extended SA v Societe Belge des Auteurs, Compositeurs et Editeurs SCRL (SABAM) (C-70/10) on whether a Belgian court injunction requiring an internet service provider to monitor peer-to-peer file sharing behaviour and filter and block unlawful activity was incompatible with Directive 2000/31 (E-Commerce Directive) arts 12 and 15. Summarises the court's guidance on the right of intellectual property holders to apply for an injunction against intermediary service providers and on the limitations that applied.
