Abstract

Discusses the implications of the European Court of Justice rulings in: (1) L'Oreal SA v eBay International AG (C-324/09) on whether eBay was liable under Directive 2000/31 (E-Commerce Directive) art.14 for hosting trade mark-infringing goods, and whether an injunction should be granted under Directive 2004/48 (Enforcement Directive) art.11 requiring their removal; and (2) Google France Sarl v Louis Vuitton Malletier SA (C-236/08) on whether Google was liable under Directive 2000/31 art.14 for permitting advertisers to register their competitors' trade marks as keywords.
