Abstract

In 2008 the RFL introduced the ‘‘club trained rule’’. The rule disadvantaged some players who were aged over 21 and were unable to satisfy the rule’s requirements. The way in which the rule was implemented and its age-related discriminatory effect demonstrates the need for judicial review to constrain the decision-making powers of sports governing bodies.
